For most homeowners around Houston, the answer is no, you can remove a tree on your own residential property without a city permit. But “most” is not “all,” and a few situations trip people up. Here is the straight version.

On private residential property, usually no permit

The City of Houston’s tree rules mostly apply to commercial development, city right-of-way, and certain protected trees, not the average homeowner taking down a dead oak in the backyard. If the tree is fully on your lot and not in the street easement, you are typically clear.

Where it gets gray:

  • Trees in the right-of-way (between the sidewalk and the street) are often the city’s, not yours.
  • New construction and commercial sites have their own tree-protection and replacement requirements.
  • Protected or heritage trees in some areas have extra rules.
